Privacy Policy

FaceTrace is operated by Thaloros Pte. Ltd. ("FaceTrace", "we", "us", "our"), a company incorporated in Singapore. This Privacy Policy explains what information we collect when you use the FaceTrace mobile application and website (together, the "Service"), how we use and share it, how long we keep it, and the rights and choices you have.

By using the Service you acknowledge this Privacy Policy. If you do not agree with it, please do not use the Service.

In short: we never sell your data. The photo you upload is sent to our face-search provider only to run your search; we do not keep a copy of it, we never add it to any index, and it never becomes findable by anyone else. Your search history and saved results are stored privately in your account so you can return to them, and you can delete everything at any time by deleting your account.

1. Information we collect

1.1 Information you provide to us

  • Account information. When you sign in with Apple or Google, we receive your email address and, if you choose to share it, your name. We use these to create and secure your account. If you use Apple's "Hide My Email", we receive the private relay address Apple generates for you.
  • The photo you upload. The query image you take or select to run a search. Its handling is described in Section 3, which is the most important section of this policy.
  • Messages you send us. The contents of support requests, privacy requests, and misuse reports, together with the contact details you include.
  • Purchase information. Subscriptions and in-app purchases are processed by the Apple App Store or Google Play. We receive confirmation that a purchase was made, the product identifier, and subscription status. We never receive or store your card number or full payment details. Apple's handling of your payment data is described in Apple's privacy policy, and Google's in Google's privacy policy.

1.2 Information we collect automatically

  • Device and app information, such as device model, operating system and version, app version, and language settings.
  • Usage events, such as which screens and features are used and when, collected through our analytics provider using a random per-install identifier that is not tied to your name or email (see Section 6).
  • Network information, such as your IP address, and the approximate, city-level location that can be inferred from it, when your device connects to our servers.
  • Diagnostic information, such as error logs generated when something in the app fails.

1.3 Your search history and saved results

When a search completes, we store a record of it in your account so you can return to it: the number of matches, each match's confidence score, the source links, and the thumbnail images returned by the search. Results you choose to save are stored the same way. Your history and saved results are private to your account, protected by access controls so that only your authenticated account can read them, and they are never sold, shared, or made visible to other users.

1.4 Information we receive from others

We receive basic sign-in information (such as your email address and a unique identifier) from Apple or Google when you use their sign-in services, and purchase and entitlement information from the app stores and our subscription-management provider (Section 5).

1.5 Device permissions

With your permission, the app uses:

  • your camera, so you can take a photo to search;
  • your photo library, so you can choose an existing photo to search;
  • notifications, if you enable them, so we can send you service messages.

You can grant or withdraw these permissions at any time in your device settings. The app functions without them except for the specific feature each permission enables.

2. What we do not do

  • We do not sell or rent your personal data, and we do not share it for cross-context behavioural advertising as those terms are defined under United States state privacy laws.
  • We do not use your uploaded photos, or the people in them, for advertising, marketing, analytics, or training of any model.
  • We do not build or keep a biometric template, faceprint, or profile of you or of the people you search.
  • We do not compile, scrape, or maintain our own index or database of faces or of public images.
  • We do not track you across other companies' apps or websites for advertising, and the app contains no advertising SDKs.
  • We do not link the photo you upload to the identity of any person; results are visual-similarity leads for you to evaluate, not identity determinations.

3. The photo you upload, and our search provider

This section describes the core data flow of the Service.

  • When you run a search, the photo you selected is transmitted over an encrypted connection to our servers, which relay it to our third-party face-search provider, FaceCheck.id, the service that maintains the index of publicly available images that searches are run against.
  • The provider compares your photo against public images and returns candidate matches, each with a similarity ("confidence") score, a source link, and a thumbnail.
  • We return those results to you and store them in your account as your search history (Section 1.3).

What happens to the photo itself. FaceTrace does not keep a copy of your uploaded photo after it has been relayed for your search. We do not store it on our servers, we do not add it to any index or database, we never reuse it as a search result for anyone else, and we do not use it for any purpose other than running the search you requested.

The provider's role. The provider processes your photo to perform the match, under its own privacy policy and retention practices, which we do not control. The provider states that uploaded photos are not added to its search index. We encourage you to review the provider's privacy policy for details of its handling.

Legal basis for this processing. You initiate every search yourself by choosing a photo and submitting it; we treat that act as your explicit consent to the processing described above. Where the person in the photo is someone other than you, laws in your region (including the EU GDPR and biometric-privacy laws such as the Illinois Biometric Information Privacy Act) may require you to have that person's consent before searching them. You are responsible for having the legal right, and any required consent, to search every photo you upload. Our Terms of Service prohibit uploading photos of minors and photos you have no right to use.

4. How we use your information

We use the information described above to:

  • provide the Service: run your searches, return results, and keep your history and saved results available to you;
  • operate, maintain, secure, and improve the Service, and diagnose and fix problems;
  • manage subscriptions and purchases through the app stores;
  • communicate with you about your account, purchases, service changes, and support requests;
  • send push notifications, if you have enabled them;
  • understand, in aggregate, how features are used, so we can improve them;
  • detect, prevent, investigate, and respond to fraud, abuse, security incidents, and violations of our Terms of Service and Responsible Use Policy;
  • protect the vital interests of any person, for example where we reasonably believe disclosure is necessary to prevent serious harm;
  • comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims.

We do not use your information to make automated decisions about you that produce legal or similarly significant effects. Search results are information for you to review and act on using your own judgement.

5. When and with whom we share information

We share personal information only with the following categories of recipients, and never by selling it:

  • Our face-search provider (FaceCheck.id), which receives the photo you upload, solely to run your search (Section 3).
  • Infrastructure providers. Our backend, database, and authentication run on Supabase, whose cloud infrastructure hosts your account data, search history, and saved results on our behalf.
  • Subscription management. We use RevenueCat to manage subscriptions and entitlements. RevenueCat receives your account identifier and purchase, subscription, and entitlement data from the app stores. It does not receive your photos or search history.
  • Apple and Google, for sign-in and payment processing under their own terms and privacy policies.
  • Analytics. We use PostHog for product analytics, configured with a random per-install identifier and without your name, email, photos, or search content.
  • Professional advisers and authorities, where required by law, regulation, legal process, or enforceable governmental request, or where disclosure is necessary to protect the safety, rights, or property of our users, the public, or FaceTrace.
  • A successor entity, if we are involved in a merger, acquisition, financing, reorganization, or sale of assets, in which case your information may be transferred as part of that transaction, subject to this policy.

Each service provider processes personal data on documented instructions and is bound to protections consistent with this policy.

6. Analytics, cookies, and tracking

The app uses a limited product-analytics tool (PostHog) to record basic usage events, keyed to a random identifier generated on your device. This helps us understand which features work and which do not. It is not used for advertising, and we do not combine it with your identity.

The app does not use the advertising identifier (IDFA), does not contain advertising or social-media SDKs, and does not track you across other companies' apps and websites. Because we do not track you, the app does not display Apple's App Tracking Transparency prompt.

Our website uses only what is necessary to serve its pages. It does not set third-party advertising cookies.

Do Not Track. Some browsers can send a "Do Not Track" signal. Because there is no common industry standard for responding to these signals, we do not respond to them at this time. If a standard is adopted, we will update this policy.

7. Push notifications and marketing

If you enable notifications, we may send you messages about your account and service activity. You can turn notifications off at any time in your device settings. We send service communications (such as receipts, security notices, and material changes to terms) as needed to operate the Service. We will only send you marketing messages if you opt in, and every marketing message will include a way to opt out.

8. Legal bases for processing (EEA, UK, and similar jurisdictions)

Where the EU or UK General Data Protection Regulation or a similar law applies, we process personal data on these bases:

  • Contract (Art. 6(1)(b)): to provide the Service you request, including account creation, running searches, storing your history, and managing purchases.
  • Consent (Art. 6(1)(a), and Art. 9(2)(a) where applicable): for the processing of the photo you upload to run a search, which you initiate; for device permissions; and for marketing, where offered. You can withdraw consent at any time (Section 12), without affecting processing that happened before withdrawal.
  • Legitimate interests (Art. 6(1)(f)): to secure and improve the Service, prevent fraud and abuse, and enforce our terms, balanced against your rights and freedoms.
  • Vital interests (Art. 6(1)(d)): to protect the life or physical safety of any person, for example in an emergency disclosure to authorities.
  • Legal obligation (Art. 6(1)(c)): to comply with laws that apply to us.

9. International transfers

We are based in Singapore, and our service providers are located in other countries, including the United States. When personal data is transferred across borders, we use appropriate safeguards where required, such as the European Commission's Standard Contractual Clauses and the UK Addendum, together with technical and organizational protections.

10. How long we keep information

When you delete your account (which you can do in the app at any time, see Section 12), we permanently delete your profile, your search history, and your saved results from our systems, revoke the sign-in token issued by Apple where applicable, and delete your subscriber record with our subscription-management provider.

11. Security

We protect personal data with technical and organizational measures, including encryption in transit (TLS) for all connections between the app, our servers, and our providers, access controls that restrict your history and saved results to your authenticated account, and least-privilege access to production systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal data occurs, we will notify you and the relevant authorities as required by applicable law.

12. Your rights and choices

You can exercise the most important choices directly in the app:

  • Delete your account and data. Settings, then Delete account. This permanently removes your profile, search history, and saved results as described in Section 10.
  • Withdraw device permissions. Your device settings control camera, photo library, and notification access.

Depending on where you live, you may also have the right to: access the personal data we hold about you and receive a copy of it; correct inaccurate data; delete data; restrict or object to certain processing; data portability; withdraw consent at any time; and not be discriminated against for exercising any right. We will never treat you differently for making a privacy request.

To exercise any right, contact privacy@facetrace.app. We will need to verify your identity, using information associated with your account; we use that verification information only for that purpose. We respond within the time your law requires (see the regional sections below). If we deny a request, you may appeal by replying to our decision, and we will respond to your appeal within the period your law requires. You may use an authorized agent to submit a request where your law allows, and we may ask the agent for proof of authorization.

12.1 European Economic Area, United Kingdom, and Switzerland

You have all the rights listed above under the GDPR, UK GDPR, and the Swiss FADP, and we respond within one month, extendable by two further months for complex requests. You also have the right to lodge a complaint with your local supervisory authority: the data protection authority of your EU member state, the UK Information Commissioner's Office (ico.org.uk), or the Swiss Federal Data Protection and Information Commissioner (edoeb.admin.ch).

12.2 United States

Depending on your state (including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana), you may have rights to know, access, correct, delete, and obtain a copy of your personal data, and to opt out of the sale or sharing of personal data, targeted advertising, and certain profiling. We do not sell personal data, we do not share it for cross-context behavioural advertising, and we do not use it for profiling that produces legal or similarly significant effects, so there is nothing to opt out of; if that ever changes, we will provide a clear opt-out first. We respond to verifiable requests within 45 days, extendable once by a further 45 days where reasonably necessary, and we will tell you if we need the extension. If we deny your request, you may appeal, and where your appeal is denied you may contact your state Attorney General.

California. California's "Shine the Light" law (Civil Code § 1798.83) permits you to request information about any disclosure of personal information to third parties for their direct marketing purposes; we make no such disclosures. We do not use or disclose sensitive personal information for purposes requiring a "Limit the Use of My Sensitive Personal Information" option.

12.3 Singapore

Under the Personal Data Protection Act 2012 (PDPA), you may request access to and correction of your personal data, and you may withdraw consent to its collection, use, or disclosure, subject to legal and contractual limits. Contact our data protection officer at privacy@facetrace.app. If you are not satisfied with our response, you may contact the Personal Data Protection Commission (pdpc.gov.sg).

12.4 Canada

We process personal data with your express or implied consent under PIPEDA and applicable provincial laws, and we may process without consent only where the law permits, for example to detect fraud, comply with a subpoena, or protect a person from harm. You may access and correct your personal data and withdraw consent, and you may complain to the Office of the Privacy Commissioner of Canada. If you are in Quebec, you have equivalent rights under Law 25, including data portability.

12.5 Australia and New Zealand

If you are in Australia or New Zealand, we handle personal information consistently with the Australian Privacy Act 1988 and the New Zealand Privacy Act 2020. You may request access to and correction of your personal information, and you may complain to the Office of the Australian Information Commissioner (oaic.gov.au) or the New Zealand Privacy Commissioner (privacy.org.nz).

12.6 Other regions

If your region grants privacy rights not listed here, contact us at privacy@facetrace.app and we will honour them as your law requires.

13. Face data

We provide this statement specifically about face data:

  • What is collected. The photo you choose to upload for a search. We do not collect face data from any other source, and we do not extract or retain facial geometry, faceprints, or biometric templates on our systems.
  • How it is used. Solely to run the search you request, by relaying the photo to our search provider, which performs a visual-similarity comparison against publicly available images.
  • How long it is kept. We do not retain the photo after your search is relayed (Section 10). The provider processes and deletes uploads under its own policy.
  • Who it is shared with. Only the search provider (Section 3). Face data is never used for advertising or marketing, never sold, and never shared with data brokers.
  • Your obligations. Where biometric-privacy laws apply to you (for example the Illinois Biometric Information Privacy Act, the Texas CUBI, or the EU GDPR), you are responsible for using the Service lawfully and for obtaining any consent those laws require from the person whose photo you search.

14. Children

The Service is for adults. You must be at least 18 years old to create an account or use FaceTrace, and you must not upload photos of anyone under 18. We do not knowingly collect personal data from anyone under 18. If we learn that an account belongs to someone under 18, or that a search targeted a minor, we will deactivate the account and delete its data promptly. If you believe a minor has used the Service or been searched through it, contact us at trust@facetrace.app.

15. Third-party links

Search results link to third-party websites, and the Service may contain other links to sites and services we do not control. Their privacy practices are their own, and this policy does not apply to them. We are not responsible for the content, accuracy, or privacy practices of third-party sites, and we encourage you to review their policies.

16. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top shows the current version. For material changes we will provide notice in the app or by other reasonable means before the change takes effect. Your continued use of the Service after a change takes effect means the updated policy applies.

Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Thaloros Pte. Ltd. ("FaceTrace", "we", "us", "our"), a company incorporated in Singapore, governing your use of the FaceTrace mobile application and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms, to our Privacy Policy, and to our Responsible Use Policy, which are incorporated into these Terms by reference. If you do not agree, do not use the Service.

These Terms also serve as the end-user license agreement for the app. Where you download the app from the Apple App Store or Google Play, the additional store terms in Sections 14 and 15 apply.

1. Definitions

  • "App" means the FaceTrace mobile application.
  • "Provider" means the third-party face-search service that performs searches (currently FaceCheck.id).
  • "Results" means the matches and related information returned by a search, including confidence scores, source links, and thumbnails.
  • "Coins" means the in-app search credits described in Section 13.

2. Eligibility and your representations

You must be at least 18 years old and legally capable of entering a binding contract to use the Service. By using the Service, you represent and warrant that:

  • you are at least 18 and meet all eligibility requirements;
  • all registration information you provide is true, complete, and accurate, and you will keep it up to date; if it is not, we may suspend or terminate your account and refuse future use;
  • you will not access the Service through automated or non-human means;
  • you will use the Service only for lawful purposes, only in jurisdictions where face-search tools are permitted, and in compliance with every law that applies to you, including facial-recognition and biometric-privacy laws;
  • you have the legal right, and where the law requires it the consent of the person shown, for every photo you upload; and
  • you will comply with these Terms and the Responsible Use Policy.

3. The Service, and what it is not

FaceTrace lets you submit a photo, which is relayed to the Provider and compared against images that are already publicly available on the open web. The Provider returns candidate matches ranked by visual similarity, and the App presents them with links to their public sources.

To be clear about what FaceTrace does not do:

  • We do not compile, scrape, index, or maintain any database of faces, of people, or of public images. The search index belongs to and is operated by the Provider.
  • We do not scrape social-media platforms, and we do not circumvent any platform's privacy settings.
  • We do not build profiles of the people who appear in Results, and we do not verify, and cannot verify, the identity of any person appearing in Results.
  • We do not retain the photo you upload after it is relayed for your search.

FaceTrace is not a consumer reporting agency, and Results are not "consumer reports" under the U.S. Fair Credit Reporting Act (FCRA) or any similar law. You may not use the Service or any Results to determine any person's eligibility for credit, insurance, employment, housing, education, tenancy, government benefits, or any other purpose covered by the FCRA or similar laws.

The Service is not tailored to regulated industries. It is not designed to comply with industry-specific regulations such as HIPAA or FISMA, and you may not use it where your communications or use would be subject to such laws. You may not use the Service in any way that would violate the Gramm-Leach-Bliley Act (GLBA).

4. Your account

You are responsible for all activity under your account and for keeping your sign-in method secure. Notify us promptly at support@facetrace.app of any unauthorized use. We may suspend accounts that we reasonably believe are compromised.

5. License

We grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on devices that you own or control, for your own lawful, personal, self-protective purposes, subject to these Terms and, for App Store downloads, to the Usage Rules in Apple's Media Services Terms and Conditions. All rights not expressly granted are reserved. The App is licensed to you, not sold.

6. Prohibited activities

You may not, and may not enable or assist anyone else to:

  • systematically retrieve data from the Service to create or compile, directly or indirectly, any collection, database, or directory, whether of Results, of people, or of anything else, without our written permission;
  • access the Service through scripts, bots, scrapers, offline readers, or any automated means, or exceed the usage limits of your plan;
  • copy, resell, sublicense, distribute, or commercially exploit the Service or Results, or use them to build, train, or improve a competing product or dataset;
  • reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent the law permits despite this restriction;
  • circumvent, disable, or interfere with security or anti-abuse features of the Service, or probe or test its vulnerability;
  • upload or transmit viruses, malware, or any material that acts as a passive or active collection or transmission mechanism;
  • impersonate any person, misrepresent your affiliation, or submit false reports or notices;
  • frame, mirror, or deep-link to the Service without permission, or remove any copyright or proprietary notices;
  • harass, abuse, or harm another person, or use the Service to send spam or unsolicited communications; or
  • use the Service for any purpose that is unlawful where you are, or that violates these Terms.

7. Prohibited uses of face search

The Service exists for identity verification and self-protection. In addition to Section 6, you must not use the Service or any Results to:

  • stalk, monitor, track, surveil, follow, or establish the movements, patterns, or location of any person;
  • harass, threaten, intimidate, coerce, blackmail, extort, dox, publicly expose, or embarrass any person;
  • search for any person under 18, or upload any photo of a person under 18;
  • make or influence decisions about any person's eligibility for employment, credit, insurance, housing, education, tenancy, or benefits (see Section 3);
  • discriminate against any person, or identify a person in order to discriminate against them;
  • violate any person's privacy rights or reasonable expectation of privacy, or circumvent the privacy settings of any platform;
  • locate or confront a person you believe may be dangerous; contact law enforcement instead;
  • create, contribute to, or maintain any database or register of individuals;
  • conduct surveillance of any kind, whether private, commercial, or governmental;
  • upload a photo you do not have the right to use, or search a person without any consent your law requires; or
  • do anything else that is unlawful in your jurisdiction, including under facial-recognition and biometric-privacy laws such as the Illinois Biometric Information Privacy Act and the Texas CUBI.

Violation of this section may result in immediate suspension or termination of your account, and, where appropriate, referral to law enforcement.

8. How search works, and its limits

Results are produced by automated visual-similarity comparison against public images and are probabilistic. A confidence score measures how similar two faces look, not certainty. Results can include false matches, especially between similar-looking people. Coverage depends entirely on what is publicly available and indexed by the Provider, so the absence of a match is not evidence that a person does not appear online. Image quality, angle, lighting, obstructions, and the age of a photo all affect accuracy. Results are provided as leads for your own evaluation: always open and review the linked sources yourself before drawing any conclusion.

9. Results are not identity confirmation

A match means two faces look similar. It is not proof of who someone is. FaceTrace shows you where a similar face appears on the public web; it does not verify any person's legal identity, and neither FaceTrace nor the Provider makes any representation that a Result corresponds to any particular person. You must not treat a Result as a confirmed identity, and you must not rely on Results as the sole basis for any decision about, or action toward, any person.

10. Your responsibility for how you use Results

You are solely responsible for your use of the Service and of any Results, and for the consequences of that use. You affirm that you accept full responsibility for using the Service lawfully, and that liability for any unlawful, harmful, or infringing use of Results rests exclusively with you. To the fullest extent permitted by applicable law, you release FaceTrace, its officers, directors, employees, and agents from all claims, demands, and damages of every kind, known or unknown, arising out of or connected with your use of Results or your interactions with any person identified through them.

11. Third-party provider

Searches are performed by the Provider under our agreement with it. The Provider's index, availability, coverage, and accuracy are outside our control, and the Provider's processing of your uploaded photo is governed by its own terms and privacy policy. We may change providers, or the scope of the search, at any time. The Provider's service and all Results are made available on an "as is" and "as available" basis.

12. Third-party websites and content

Results link to third-party websites, and the Service may contain other links to sites, content, and services that we do not own, operate, or monitor. We do not endorse, and are not responsible for, any third-party site or its content, accuracy, opinions, privacy practices, or security. When you follow a link out of the Service, these Terms no longer govern, and you act at your own risk. Any purchase or interaction you make with a third party is solely between you and that third party, and you agree to hold us harmless from any harm arising from it.

13. Subscriptions, Coins, and billing

Subscriptions. Some features require a paid auto-renewing subscription (for example, weekly or annual "FaceTrace Pro"). The subscription name, duration, price, and what it includes are shown in the App before you buy. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.

Automatic renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in your App Store or Google Play account settings; deleting the App does not cancel a subscription.

Free trials. If a free trial is offered, its length and the price you will be charged when it ends are shown before you start it. The trial converts automatically to a paid subscription unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

Coins. Coins are consumable in-app search credits. Coins you purchase do not expire. Promotional or bonus Coins that we grant for free may be subject to the conditions stated when granted. Coins are a limited, non-transferable license to use Service features; they are not money or property, have no cash value, cannot be redeemed or exchanged outside the Service, and are not refundable except where required by law or by the app store's policies. Coin balances are forfeited when your account is deleted.

Price changes. We may change prices for future periods. For subscriptions, price changes take effect at your next renewal, and where the law or the app store requires, only after notice or your consent.

Refunds. Purchases made through the Apple App Store or Google Play are subject to the refund policies of those stores, and refund requests must be directed to them. Except where required by applicable law or the relevant store's policy, all payments are final and non-refundable.

14. Apple App Store: additional terms

If you download the App from the Apple App Store, the following apply:

  • Acknowledgement. These Terms are between you and Thaloros Pte. Ltd. only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. These Terms may not provide usage rules for the App that conflict with the Apple Media Services Terms and Conditions.
  • Scope of license. The license granted in Section 5 is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. In the event of any third-party claim that the App, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of the claim.
  • Legal compliance. You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints, or claims about the App should be directed to Thaloros Pte. Ltd., Singapore, support@facetrace.app.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

15. Google Play: additional terms

If you download the App from Google Play, your download and use of the App are also subject to the Google Play Terms of Service, and Google is not a party to these Terms and has no obligations under them.

16. Intellectual property

The Service, including its software, design, text, graphics, logos, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license in Section 5, nothing in these Terms transfers any right, title, or interest to you. "FaceTrace" and the FaceTrace logo are marks of Thaloros Pte. Ltd. You may not use them without our prior written permission.

17. Feedback and submissions

If you send us questions, comments, ideas, suggestions, or other feedback, you agree that we may use them for any purpose, commercial or otherwise, without acknowledgement, compensation, or obligation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to do so. You warrant that your submissions are original to you or that you have the right to submit them, and that they do not infringe any third party's rights.

18. User data

We perform routine backups of account data, but you are responsible for any data you transmit or that relates to activity you undertake using the Service. Except as required by law or as stated in the Privacy Policy, we are not liable to you for any loss or corruption of such data, and you waive any claim against us arising from it. Your privacy rights, including deletion, are governed by the Privacy Policy.

19. Privacy

Our Privacy Policy describes how we collect, use, share, and retain personal information, including the handling of the photos you upload. By using the Service, you acknowledge the Privacy Policy.

20. Service management

We reserve the right, but not the obligation, to: monitor the Service for violations of these Terms; take appropriate legal action against anyone who violates the law or these Terms; refuse, restrict, limit, disable, or terminate access of any user; remove or disable content that is unlawful or violates our policies; and otherwise manage the Service to protect our rights and property and its proper functioning.

21. Modifications and interruptions

We may change, suspend, or discontinue all or part of the Service at any time, with or without notice, and we will not be liable to you or any third party for doing so. We do not guarantee the Service will be available at all times; hardware, software, maintenance, and other problems may cause interruptions, delays, or errors. We have no obligation to provide updates, corrections, or new features, except as required by law or by the app stores.

22. Corrections

The Service may contain typographical errors, inaccuracies, or omissions, including in descriptions, pricing, and availability. We reserve the right to correct them and to update information at any time without prior notice.

23. Term and termination

These Terms remain in effect while you use the Service. You may stop using the Service and delete your account at any time in the app. We may, without notice and without liability, suspend or terminate your access, delete your account, and bar future use, if you breach these Terms or the Responsible Use Policy, if the law requires it, or where we reasonably believe it is necessary to protect our users, third parties, the public, or the Service. If we terminate or suspend your account for breach, you are prohibited from registering a new account in your name, a fake or borrowed name, or the name of any third party. We reserve the right to pursue civil, criminal, and injunctive remedies where appropriate. Sections that by their nature should survive termination (including Sections 3, 6 to 12, 16 to 18, and 24 to 32) survive.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT THE SERVICE OR RESULTS WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, SECURE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY RESULT CORRESPONDS TO ANY PARTICULAR PERSON. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY MADE HERE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS EXCLUDES RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

25. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY RESULTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

26. Indemnification

You agree to defend, indemnify, and hold harmless FaceTrace and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use or misuse of the Service or any Results; (b) your breach of these Terms or the Responsible Use Policy; (c) your violation of any law or of any third party's rights, including privacy, publicity, biometric-privacy, and intellectual-property rights; (d) any photo you upload; or (e) any harm you cause to any person through your use of the Service. We reserve the right, at your expense, to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence.

27. Governing law

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of Singapore, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live.

28. Dispute resolution

If you have a dispute with us, contact support@facetrace.app first, and we will try in good faith to resolve it informally within 30 days. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Singapore, except where the mandatory law of your place of residence requires or permits proceedings there. To the extent permitted by applicable law, any proceedings shall be conducted on an individual basis, and neither of us will bring or participate in a class, collective, or representative action against the other; where such a waiver is not permitted, this sentence does not apply.

29. Electronic communications and signatures

Using the Service, sending us email, and completing in-app forms constitute electronic communications. You consent to receive communications from us electronically, including in-app notices and email, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. You agree to the use of electronic signatures, contracts, and records, and waive any requirement for original signatures or non-electronic records, to the fullest extent permitted by law.

30. Notice to California users

Under California Civil Code Section 1789.3, California users are entitled to know that they may file grievances and complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

31. Jurisdictions where the Service is unlawful

The Service is not intended for distribution to, or use by, any person or in any jurisdiction where such distribution or use would be contrary to law or regulation, including jurisdictions that restrict or prohibit facial-recognition or face-search services. If you access the Service from such a location, you do so on your own initiative and at your own risk, and you are solely responsible for compliance with local law. We may restrict the availability of the Service in any jurisdiction at any time.

32. General

These Terms, together with the Privacy Policy and Responsible Use Policy, are the entire agreement between you and us regarding the Service, and supersede all prior agreements on that subject. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of it. Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and us. These Terms will not be construed against us merely because we drafted them, and you waive any defence based on the electronic form of these Terms or the absence of signatures. Neither party is liable for failure to perform caused by events beyond its reasonable control.

33. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. For material changes we will provide notice in the app or by other reasonable means before the change takes effect. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not agree to a change, stop using the Service and delete your account.

Responsible Use Policy

FaceTrace exists to help people verify identity and protect themselves. It is not a surveillance tool.

The rule of thumb: use FaceTrace on people you are interacting with, to keep yourself safe. Never use it to monitor, intimidate, or expose someone.

Encouraged uses

  • Vetting a dating match before meeting in person.
  • Catching a catfish, impersonator, or scammer.
  • Verifying a rideshare or delivery driver.
  • Screening a buyer, seller, hire, or freelancer.
  • Reconnecting with a long-lost contact.
  • Checking what the public web shows about your own face.

Prohibited uses

  • Surveillance, stalking, or tracking a person's movements.
  • Harassment, intimidation, doxxing, or exposing private individuals.
  • Blackmail, extortion, or coercion of any kind.
  • Searching for minors or uploading photos of anyone under 18.
  • Discrimination in housing, employment, credit, or insurance.
  • Locating or confronting someone you believe may be dangerous; contact law enforcement instead.
  • Building any database of individuals.
  • Any use that breaks the law in your jurisdiction.

Enforcement

We may suspend or terminate accounts that violate this policy, and where appropriate we refer matters to law enforcement. Report misuse via our Contact page or trust@facetrace.app.
